The hidden risks of filing your own Trademark
DIY has its place – in your business and mine.
- Creating your own program? – Yes!
- Setting your own schedule? – For sure!
- Using my DIY Legal Templates – Absolutely!
(In fact, I’ve created over 50 DIY Legal Templates because I know how essential it is to save time and money as a small business.)
But one thing I NEVER recommend doing on your own is a Trademark.
Believe me, I totally get the temptation.
The Trademark Application looks straightforward. (Be warned: It’s not!)
The USPTO website makes it seem simple.
And you might think, “I’m a smart person. How hard can this be?”
One of my clients (let’s call her Rachel) thought the same thing.
Rachel had landed on a super clever name for her program and decided to file a Trademark Application herself.
She did a quick look online to be sure no one else was using the name.
It looked like no one was using her exact same brand name so she filed a Trademark Application with the USPTO and assumed it would be granted.
6 months later, she received what’s called an “Office Action” from the USPTO. It said:
⛔ Her description was too vague.
⛔ The Trademark class she selected was incorrect.
⛔ And there was a “likelihood of confusion” with another brand.
She panicked.
What she thought would be easy-peasy turned into stress, delays and additional legal fees to fix it.
Worst of all?
Now she was worried whether her brand would even be approved. 😢
When she reached out to me for help, she said: “I wish I had just done it right the first time.”
I hear this all.the.time. These situations break my heart. 💔
Here’s the truth most people don’t realize:
Trademarking isn’t just filling out a form online.
It’s knowing how to:
- Conduct a proper Trademark Search that goes far beyond a simple database search or internet inquiry.
- Selecting the correct Trademark class (there are 45 of them!)
- Draft a strong, specific description that doesn’t let other people slide in behind you (this is the key part!)
- Submit your proof of using your brand so the USPTO doesn’t question your use.
DIY Trademarking can look cheaper upfront for sure. But doing it CORRECTLY is far less costly in money, stress, and time in the long run.
Let me put it this way: I’ve been helping clients file registered Trademarks for 13 years.
AND I have another lawyer on my team who is a full-time intellectual property attorney who files and defends Trademarks on the daily.
Together, we’ve filed over 70 successful trademarks for my clients.
