An Agreement For Hiring a Therapist as a Team Member is an agreement for bringing a Therapist onto your team as an independent contractor (not an employee).
This Agreement is what you use when bringing a Therapist on board as a 1099 INDEPENDENT CONTRACTOR. It is NOT what you use when hiring a Therapist as a full-time or part-time salaried employee of your Company.
There is a huge legal – and practical – distinction between an independent contractor and an employee. (If you want to hire a Therapist as an employee, speak with a lawyer and accountant in your state so you’ll know the employment and tax laws you must follow.)
This Agreement is a legally binding contract which spells out the services the Therapist will be providing and how and when you’ll pay the Therapist. It’s the best way to make sure you are on the same page right from the outset.
IMPORTANT NOTE:
If you’re a licensed practitioner wanting to hire a Therapist to join your team, please talk with me (or another lawyer) before you use this Agreement. In some states, you’re REQUIRED to bring the Therapist onto your team as an employee – and you CAN’T use a contract with the Therapist – either due to state employment laws or state nutrition laws which affect how the Therapist can practice.
If you’re NOT a licensed practitioner but you work in the area of health and wellness, please also talk with an attorney who understands your business, because you still need to be sure that the Therapist you’re going to add to your team is legally allowed to perform ALL of the services you’re requesting without violating any of their state laws or other laws related to the fields of medicine, health or wellness.
