if you hold fitness courses, yoga classes
or personal training sessions ONLINE
– whether it’s a single drop-in class or a bunch of group classes –
don’t leave yourself without any legal protection.
you’ll want your clients to sign an online fitness liability waiver.
what is an online fitness liability waiver?
The Online Fitness Liability Waiver is a waiver specifically designed for ONLINE fitness classes or personal training sessions that you hold through Zoom or another online format. (It’s not for in-person classes.)
It’s a written waiver that’s your foundational level of legal protection – your first line of defense – that your client signs and gives back to you BEFORE they hop onto your online classes or personal training sessions to show they agree to your policies and understand your liability waiver.
Now, know that it’s not a contract which outlines the number of classes you have, how much they cost, what happens if the client doesn’t pay you or your refund policy. That’s an entirely different type of legal document altogether.
Rather, this is a simple liability waiver which lets your online fitness clients know that you’re not liable for how they’re moving their body, whether they’re using proper form, or for any injuries they may incur.
why do you need it?
From a PRACTICAL standpoint, every client needs to understand and agree to your waiver and be informed that they are assuming any risks that come with online workouts. You want them to know they are personally responsible for their own bodies and movement so they don’t get confused or injured and come after you if they get injured while working out.
This document protects you in 3 ways:
1. It stops you from worrying about having NOTHING legal in place…so you feel safe to hold your fitness classes or training sessions online.
2. It sets the ground rules around liability so your clients know where your liability ends and where their responsibility begins.
3. It creates boundaries and avoids confusion so nothing is ambiguous.
Know that the Online Fitness Liability Waiver does not get you completely off the hook as a fitness instructor, yoga teacher or personal trainer, of course! You still have to behave legally and ethically and safely.
You need to use reasonable care to make sure your exercises and instructions and asanas are safe, that any training you’re doing with any equipment is appropriately demonstrated, and that you use safety precautions, warnings, and efforts to keep everyone safe and healthy.
